New E-Commerce Rules Tighten Oversight of Online Sellers and Digital Platforms

RRI.CO.ID, Jakarta - Indonesia is set to tighten oversight of its fast-growing digital marketplace after the government signed a new regulation governing e-commerce businesses. The new rules require online merchants to obtain business licenses and impose stricter obligations on digital platforms.
On Thursday, June 4, 2026, Trade Minister, Budi Santoso, had signed the Trade Ministry Draft Bill on Trade Through Electronic Systems (PMSE). The regulation replaces the 2023 framework and is designed to create a more orderly online trading environment.
"The refinement of PMSE regulations through this new Trade Minister Regulation aims to strengthen a digital trade ecosystem that is fair, healthy, and beneficial," Budi Santoso said in his ministry's written statement.
Some key focuses in the new regulation include micro-small business-owned (MSE) and domestic product visibility priority , business permits, promo fees and policy tranparency, as well as promotional incentive for MSEs. There are also reporting and dispute mechanism, AI in product marketing, and protection from unhealthy trade practices.
The government added two business models under the PMSE framework. The first is ride-hailing, where the new bill only includes goods trade activity that is facilitated through commerce features of the ride-hailing apps.
"Therefore, we regulate the sales transactions, not the transportation services," he said.
The second is online travel agent. This includes the travel services sales and orders to the consumers, as well as tickets for transportation, accomodation, attraction, and travel packages.
In addition, Minister Budi Santoso, explained that the two business model addition into the framework was to respond the dynamic digital trade landscape. He added, this will give businesses legal certainty.
To prevent disruption, businesses will be given a transition period to comply with the new licensing requirements. The minister said his ministry will continue assisting merchants through training, outreach programs, and other support measures during the rollout.
