Housing Ministry Seeks Legal Certainty to Accelerate Use of State Land

RRI.CO.ID, Jakarta – To accelerate state-run housing projects, the Ministry of Housing and Settlement Areas (PKP) has partnered with the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) and the Anti-Land Mafia Task Force to pursue legal breakthroughs.

PKP Minister Maruarar Sirait (Ara) said legal certainty over land is essential for speeding up the construction of vertical (apartment) housing and landed houses. These units are intended for low-income communities (MBR) in need of decent housing.

“We want new breakthroughs so this process can move quickly, as the plans and funding are already in place. We thank the Director General of PSKP at the Ministry of ATR/BPN and the Head of the Anti-Land Mafia Task Force for upholding justice,” Minister Ara said in a written statement on Friday, September 4, 2026.

The meeting discussed accelerating the use of state land without burdening the state budget (APBN). One plan involves constructing around 2,000 apartments on land owned by state-owned railway operator PT Kereta Api Indonesia (KAI).

The land is located in Jakarta and Bandung, with funding to be provided through the Corporate Social Responsibility (CSR) program of PT Astra International Tbk. The PKP Ministry is urging the prompt resolution of legal and land administration issues in accordance with regulations.

Minister Ara emphasized that the land status must be “clear and clean” before it can be used for public housing construction. This step is necessary to provide legal certainty for both the public and the business sector.

“The construction and funding plans are ready. Therefore, what is needed are the right legal and governance measures to quickly resolve land issues and prevent delays in development for the people,” he said.

Director General for the Handling of Agrarian Disputes and Conflicts (PSKP) at ATR/BPN, Ilyas Tedjo Prijono, said his office will analyze the land proposed by the PKP Ministry. The analysis covers the land’s status, history, legal aspects, and utilization.

Regarding land owned by PT KAI, Ilyas explained that it originated as state land held under a right of ownership. It later became subject to a right of use held by the Ministry of Transportation before being transferred to PT KAI.

“From a regulatory standpoint, the land rights are recorded as a Right of Use held by PT KAI. We will comprehensively review and analyze all land-related aspects in accordance with applicable regulations,” Ilyas said.

Separately, Head of the Anti-Land Mafia Task Force, Hendra Gunawan, said two legal processes are underway concerning the land: a civil lawsuit filed by the public against PT KAI and a criminal case.

“The criminal process has reached ‘Stage One,’ meaning the case file has been submitted to the Jakarta High Prosecutor’s Office. A special case review has also been conducted under the Anti-Land Mafia Task Force for the Jakarta Special Capital Region,” he said.

The PKP Ministry, ATR/BPN, and the Anti-Land Mafia Task Force will continue coordinating to resolve land-related issues. These efforts aim to accelerate the “Three Million House Program” by optimizing available land and assets. (Misni Parjiati)
