Presidential Regulation Sets Allowance Standards for Ad Hoc Judges

RRI.CO.ID, Jakarta – President Prabowo Subianto has issued Presidential Regulation (Perpres) No. 5/2026 on the Financial Rights and Facilities of Ad Hoc Judges, enacted on February 4, 2026, to strengthen the quality of justice administration in Indonesia.
According to a copy of the regulation quoted by Antara on Monday, May 4, 2026, financial rights and facilities for ad hoc judges must be regulated because they are officials exercising judicial power and therefore need to be integrated into the legal system.
The regulation aims to improve the quality of the judiciary by supporting ad hoc judges who are honest, professional, and independent.
Presidential Regulation No. 5/2026 also replaces several previous provisions on the financial rights and facilities of ad hoc judges, including honorariums, which had undergone multiple amendments.
Key provisions include the right of every ad hoc judge to receive a monthly allowance, inclusive of income tax. The state also provides facilities such as official housing and transportation within the assigned area, health insurance, security while carrying out duties, and travel expenses (transportation and accommodation) equivalent to those of judges in the court where they serve.
The regulation further stipulates an award at the end of the term of office amounting to twice the allowance. Judges who do not complete their full term will receive the award proportionally based on their length of service.
Perpres No. 5/2026 also regulates provisions for ad hoc judges drawn from civil servants (PNS), Indonesian military personnel (TNI), and police officers (Polri). Those serving as ad hoc judges are not entitled to income from their original institutions while receiving their allowance.
Regarding discipline, ad hoc judges who are dishonorably discharged due to severe administrative sanctions or who are sentenced to imprisonment under a legally binding court decision will not receive award money. The regulation also states that ad hoc judges who resign or are dismissed are not eligible for pensions or severance pay.
With this regulation in effect since February 4, 2026, the judicial system at the special, first instance, appeals, and cassation court levels is expected to operate more optimally and accountably.
