House of Representatives Reviews Issues in THR Payment Regulations

RRI.CO.ID, Jakarta - Commission IX of the Indonesian House of Representatives (DPR RI) has brought attention to the need to regulate the provision of holiday allowances (THR) for workers in partnership systems. Currently, there are no detailed rules governing the obligation to provide THR for partnership work schemes.

This was stated by Putih Sari, Deputy Chairperson of Commission IX of the DPR RI. As partnership-based employment patterns continue to grow in various sectors, the need for a legal framework to regulate holiday allowance become more apparent.

"Indeed, there are no detailed regulations yet for the provision of THR for partnership work systems. Perhaps it won't be in the form of THR, but rather a holiday bonus. This requires a separate legal framework, and we will push for it," she said in a press statement in Jakarta, quoted on Monday, February 16, 2026.

Putih Sari explained that partnership workers have different characteristics than those under formal employment relationships. She believes the regulatory approach to THR payments needs to be formulated carefully.

"To provide protection, without ignoring the nature of the existing partnership, Commission IX will encourage the Ministry of Manpower to conduct an in-depth study and coordinate with stakeholders," she said.

She also highlighted several Constitutional Court (MK) decisions that have annulled several regulations in the employment sector. This situation provides momentum for the House of Representatives (DPR) to restructure the employment legal framework more comprehensively.

"We are no longer revising the Employment Law. But perhaps we will create a new law in the employment sector," said Putih Sari.

Previously, online motorcycle taxi drivers, including Gojek, Grab, and Maxim, questioned the calculation mechanism for the 2025 holiday allowance (THR) for online motorcycle taxis (ojol). This is because President Prabowo Subianto guaranteed that ojol drivers and online couriers would receive the 2025 THR from online transportation companies.

The 2025 THR calculation mechanism for Gojek, Grab, and Maxim motorcycle taxi drivers is in accordance with Ministry of Manpower of the Republic of Indonesia's Circular Letter Number M/2/HK.04/III/2024.

This policy was announced after President Prabowo met with leaders of online transportation companies, such as Gojek CEO Patrick Waluyo and Grab CEO Anthony Tan, on Monday, March 10, 2025.

The 2025 THR amount for Gojek, Grab, and Maxim motorcycle taxi drivers is still awaiting further confirmation from the government. However, in general, THR calculations are usually based on their basic wages and fixed allowances.

According to Circular Letter of the Minister of Manpower Number M/2/HK.04/III/2024, motorcycle taxi drivers and package couriers are categorized as workers under a Fixed-Term Employment Agreement (PKWT). This means that motorcycle taxi drivers who meet the requirements will receive THR in accordance with applicable regulations.

According to Minister of Manpower Circular Letter Number M/2/HK.04/III/2024, motorcycle taxi workers are eligible for a holiday allowance (THR) equivalent to one month's wages. This allowance is given to workers who have worked for 12 months or more. For workers with less than 12 months of service, the THR is calculated proportionally based on length of service.

Casual workers' one-month wages are calculated using two methods. If they have worked for 12 months or more, their one-month wage is calculated based on their average income over the last 12 months.

For workers with less than 12 months of service, the average monthly income over that period is used for calculation. For workers who receive wages based on unit output, the THR is calculated using the average income over the last 12 months before Eid al-Fitr. ***
