Govt Affirms Overtime Pay for National Holiday Work

RRI.CO.ID, Jakarta - Minister of Manpower, Yassierli has affirmed that workers who continue to work on national holidays are entitled to their employment rights in accordance with applicable regulations, including overtime pay.

Yassierli explained that, in principle, workers are not required to work on national holidays or official holidays. However, exceptions apply to certain types of work that must operate continuously.

“Employers may only require workers to work on national holidays for jobs that must operate continuously,” Yassierli said during the signing of the Three-Minister Joint Decree on National Holidays and Collective Leave Days for 2027 in Jakarta, Tuesday, September 15, 2026.

According to Yassierli, companies may continue to operate on national holidays under certain circumstances based on a written agreement between employers and workers. If workers are required to work, their employment rights must be fulfilled in accordance with applicable regulations.

“Employers who require workers to work on national holidays must pay overtime wages,” he stressed.

Yassierli also explained the provisions on collective leave days for workers. Collective leave is considered part of annual leave, and taking it is optional.

Workers who take collective leave will have the corresponding days deducted from their annual leave entitlement. Meanwhile, workers who continue to work on collective leave days will not have their annual leave entitlement reduced and will receive their regular wages as on a normal working day.

These provisions are part of the labor regulations that companies and workers need to take into account following the government’s determination of national holidays and collective leave days for 2027.
